  • Enrolment-Payment -Terms and Conditions- Private Policy Welcome to French101! We've simplified our Terms and Conditions to make them more user-friendly. Please take a moment to read these terms, as they form the agreement between you, as a user of French101, and us, as the provider of French101 services. 
    1. Who We Are We ‘’French101’’, operated by Motion Asia Management Inc, a company registered in Cana
    da, British Columbia V4K0C9 and/or its affiliates or its authorized representatives/resellers (“we”, “us”, “our” or the “Company”), aim is to provide you with valuable learning materials and related services through our website, french101.ca (“Website”) or through designated platforms.   
    2. Agreement Overview By using our product French101 (“Service”), you agree to abide by these Terms and Conditions (referred to as the "Terms" or the "Agreement").  Also our Privacy Terms and Subscription Terms are incorporated to these Terms by reference, which means they are part of the Terms. Any translation of the Terms from the English version is provided for your convenience only.  
    3. Eligibility If you do not agree with any part of these Terms and any related documents or you are not eligible to use our Services, please do not access any part of our Service. To use French101, you must be at least 19 years old and have the legal capacity to enter into an agreement. If you're under 19, you need your parent's permission. If you don't agree with these terms or you're not eligible, please do not use our Service. 
    4. What We Offer
    French101 provides a range of educational materials, including articles, reading materials, and test questions to learn the French Language. We also offer an AI Chat feature for educational purposes. All the materials and services are collectively referred to as “Digital Content”. Please read carefully the disclaimers and warranties below with regards to this Digital Content. You will have access to the Digital Content and our product French101 only after registering for the Service, which means you will have to register and pay for the enrolment plan of 6 weeks per Franch language level and proficiencies depending on what you select at the time of purchase. After the purchase and while using the Service you may be offered additional paid features. Please read carefully any offers you receive from us.
    5. Enrolment per Level of study .What we may offer Based on the level option you select at the time of purchase we may offer you: 1.     Enrolment per Level of study will be automatically charged a full price that grants you ongoing access to the Service for a specified period (6 weeks ) Additional paid features are optional functionalities or services that we may offer to you in addition to the enrolment plan per level one-time purchases bases.
    6. Billing and Cancellation We bill for our services through credit card or debit card payment providers (Visa, Mastercard and others). Your payment method will be charged according to your enrolment by level plan. 
    Methods of payment Payment methods for the Services are billed by French101 via Credit Card or Debit card payment providers.
    French101 charges the applicable fees to the payment card you submit at the time of purchase (after you confirm by single-touch, or entering your payment method details on the web, or otherwise accepting enrolment by level terms provided on the payment screen on our web page). You authorize us to store your payment method(s) and automatically charge the applicable subscription fees to the payment card that you submit for the future enrolment per level term.
    7. Data Protection We collect, store, and process your data in accordance with its Privacy Policy. By using the Service you agree to the collection, storage, and processing of the data in the manner and for the purpose described in the Privacy Policy. 
    8. Use of Information and Intellectual Property All the information, text, images, graphics, marks, logos, compilations (meaning the collection, arrangement or assembly of information), data, other content, software and materials available through or at our Website constitutes our property or property of third parties. You're granted a non-exclusive license to use our Service for personal, non-commercial purposes only. No other rights or use with regards to the Services is available to you unless otherwise expressly written in these Terms. Please don't infringe on our intellectual property rights. Information you provide us when you sign up to French101, your "User Content," belongs to you, and we do not obtain any proprietary right over it. However, you agree that we may retain copies of all registration information and User Content and use all such information as reasonably required or incidental to the operation of Services and as described in these Terms. If you believe your intellectual property rights have been violated, contact us through the Support Center. We may request additional information and delete or disable content alleged to be infringing and we may also terminate accounts of repeat infringers.
    9. Third-Party Ads Our Service may contain links to third-party websites and advertisements for third-party products or services. We're not responsible for these third-party ads, and you use them at your own risk. When you link to a third-party website, the terms and conditions of such a website will apply to your relationship with the owner of that website. Please be careful and conduct your own investigation about any such advertisements. You hereby release us, our officers, employees, agents and successors from any claims, demands and any losses, damages and action of any kind whatsoever directly or indirectly related to such third-party advertisements, products and services. 
    10. Compliance The Services are provided in accordance with the laws of  British Columbia, Canada. We make no representation or warranty that a Service or the Digital Content are applicable or available for use in other locations. If you use the Services from a jurisdiction other than British Columbia, Canada, you agree to do so at your own risk, and you are responsible for complying with any and all local laws applicable to your use of a Service.
    11. Copyright Statement French101 copyrighted the product, including but not limited to all materials, logo, etc. Any redistribution or reproduction of part or all the Services and/or Digital content available through subscription services in any form is prohibited. Any other proposed use of Services and/or Digital Content shall be granted by French101 in the form of formal written permission. 
    12. User Representations and RestrictionsRepresentations and Warranties By using the Service, you represent and warrant that: you have the legal capacity and you agree to comply with these Terms;
    you are not under the age of 16;
    you will not access the Service through automated or non-human means, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Service, or using or launching any unauthorized script or other software; you will not use the Service for any illegal or unauthorized purpose; you are not located in a country   is subject to a Canadian and/or U.S. government embargo, or that has been designated by the Canadian and/or U.S. government as a ”terrorist supporting” country; you are not listed on any Canadian/U.S. government list of prohibited or restricted parties; and your use of the Service will not violate any applicable law or regulation.If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to refuse any and all current or future use of the Service (or any portion thereof). You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended except those that are specifically authorized or approved by us. 
    Restrictions As a user of the Service, you agree not to: systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us; make any modification, adaptation, improvement, enhancement, translation, or derivative work from the Service; use the Service for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the Service; circumvent, disable, or otherwise interfere with security-related features of the Service; engage in unauthorized framing of or linking to the Service; decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service; attempt to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service;
    use the Service to send automated queries to any website or to send any unsolicited commercial e-mail; disparage, tarnish, or otherwise harm, in our opinion, us and/or the Service; use the Service in a manner inconsistent with any applicable laws or regulations; or otherwise infringe these Terms.
    13. Refund Policies Our refund policy is designed with fairness and legal compliance in mind. Refunds for services, whether on a subscription or one-time purchase basis, are granted at our discretion and in accordance with applicable laws, terms, and conditions. For digital services, the right of withdrawal is typically lost once the service is deemed consumed, as digital content is considered fully delivered upon purchase validation. However, BC, Canadian residents have a 07-day refund period from the one time purchase net price start, as per the Consumer Rights Directive, provided the service hasn't begun with their expressed consent. Outside the BC, Canada, all charges are generally non-refundable, except in specific legal circumstances.  Users may be eligible for a full refund if they meet certain criteria, including contacting us within 30 days of purchase and demonstrating adherence to the provided plan. Refund requests should be directed to study@french101.ca, and each case will be reviewed individually. It's important to note that refunds are not granted for personal or financial reasons outside these conditions. 
    14. Disclaimers of warranties and liabilities As for information on the Service. Any statement or information that may be posted on the Service is for informational and educational purposes only and is not intended to replace or substitute for any professional financial, legal, or other advice. As for any advice. French101 does not provide investment or financial advice or advocate the purchase or sale of any security or investment via the Service. As for expectations. There is no guarantee that the Digital Content will meet your or any other person's needs or requirements. The Service may not be appropriate for all persons and is not a substitute for professional financial or learning advice. As for any results. We make no guarantees about the level of success you will have, and you accept the risk that results will vary from person to person. The Service may provide examples of exceptional results that do not apply to the average person and are not intended to represent or guarantee that anyone will achieve the same or similar result. As with any investment learning program or service, your results will vary and will be based on a number of factors, including but not limited to your individual capacity, life experience, financial status, starting point, expertise, and level of commitment. You agree that French101 is not liable for any success or failure of your financial/language proficiency risk that is directly or indirectly related to the purchase and use of the Service. As for capital/language proficiency risk. French101 is an education platform, you can not invest with us. You should acknowledge if you decide to invest yourself there is a risk of capital loss and income is not guaranteed and will depend on various factors. Your decision to make an investment should be made at your own discretion and upon your own will only. As for any representations. French101 makes no representations or warranties and, to the fullest extent permitted by law, expressly disclaims any and all liability relating to your reliance on the statements or other information offered or provided within or through the Service. If you have specific concerns or a situation arises in which you require professional advice, you should consult with an appropriately appropriate, trained and qualified specialist.
    As for other products used. The inclusion of any sites or other product information to Service does not imply a recommendation but merely brings possible options. It is your own responsibility to conduct appropriate investigations and inquiries concerning indicated information before taking any decisions. As for information. We specifically disclaim any representations or warranties, express or implied, including, without limitation: Warranties relating to the accuracy, reliability, correctness, timeliness or completeness of information made available on the website or otherwise by us, including any advice, opinion, statement, or other material or database displayed, uploaded or distributed and available through the website, and warranties otherwise relating to performance, non performance, or other acts or omissions by us or any third party. ACCESS TO, AND USE OF, THE SERVICE (INCLUDING THE DIGITAL, CONTENT AND USER CONTENT), AND THIRD PARTY ADS ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTING SYSTEM OR LOSS OF DATA RESULTING THEREFROM. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, YOU AGREE THAT THE AGGREGATE LIABILITY OF FRENCH101 TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE APP, CONTENT, SERVICE OR PRODUCTS, IS LIMITED TO THE AMOUNTS YOU HAVE PAID TO FRENCH101 FOR ACCESS TO AND USE OF THE SERVICE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE TERMS BETWEEN FRENCH101 AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION. 
    16. Indemnification
    In no event will French101 be liable for any loss, damage, or injury, including, without limitation, any indirect, consequential, special, incidental, or punitive damages arising out of, or in connection with, the use of the Services, including but not limited to any decision made or action taken in reliance on the information contained in the Services, or any errors or omissions in the Services. By using the Services, you agree to indemnify, defend, and hold harmless French101 from and against any and all claims, complaints, lawsuits, or other liabilities, including reasonable attorneys' fees, that may arise from your use of the Services or your decision to follow any advice, recommendation, or instruction provided therein. You agree to indemnify and hold French101, its successors, subsidiaries, affiliates, any related companies, its suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of (i) your use of the Service or Digital Products, (ii) your User Content, or (ii) your violation of these Terms. 
    17. Dispute Resolution If a dispute arises, we'll make every effort to resolve it through negotiation. Please send any complaints and requests directly to the Support Service. We will make all the efforts to address your issue. If we can't reach an agreement, disputes will be governed by the laws of British Columbia, Canada, and resolved through mediation in the District Court of Delta,BC. 
    18. Miscellaneous We may occasionally update our Service and may change information without notice. Please note that certain circumstances beyond our control may cause delays in providing our Service. We may at any time modify or discontinue, temporarily or permanently, the Service (or any part thereof) at our sole discretion with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service (to the maximum extent permitted by law). 
    19. Changes Sometimes we may change these Terms. Usually it happens when the legislation or some part of our business changes. We may notify you about the critical changes, but are not obliged to do so. If you keep using our Service after any changes, it means you accepted such changes. If you received a notice from us regarding any such changes, you will have 07 (seven) days to object or opt-out from Service, if you do not object or opt-out, it will mean that you accepted such changes of the Terms. We may also automatically collect from your device: language settings, IP address, time zone, type and model of a device, device settings, operating system. We need this data to provide our services, analyze how our customers use the service and to measure ads. For improving our service and serving ads, we use third party solutions. As a result, we may process data using solutions developed by Amazon Web Services, Facebook, Google, TikTok, Apple, PayPal. Therefore, some of the data is stored and processed on servers of such third parties. This enables us to: (1) analyze different interactions (how often users make subscriptions, what is the most popular users’ financial goal, what is the average time spent by users on the service); (2) serve ads (and are able to show them only to a particular group users, for example, to subscribers). Consequently, we, in particular, better understand in what of our features and content you see the most value and are able to focus on them to enhance your experience and increase the quality of our products. Please read our Privacy Policy below to know more about what we do with data (Section 3), what data privacy rights are available to you (Section 6) and who will be the data controller (Section 1).     Privacy Policy This Privacy Policy explains what personal data is collected when you use the French101 Website located at https://french101.ca/ (the “Website”) and the services and Digital products provided through it (the “Service”), how such personal data will be processed.     2. Categories of Personal Data We Collect We collect data you give us voluntarily (for example, when you enter your date of birth, name, status or email). We also collect data automatically (for example, your IP address) and use third-party service providers for such collection. Data you give us. You provide us information about yourself when you register for and/or use the Service. For example: age, data, email address. Data we collect automatically: 2.1. Data about how you found us. We collect data about your referring URL (that is, the place on the Web where you were when you tapped on our ad). 2.2. Device and Location data. We collect data from your device. Examples of such data include: language settings, IP address, time zone, type and model of a device, device settings, operating system and its version. 2.3. Usage data. We record how you interact with our Service. For example, we log your taps/clicks on certain areas of the interface, the features, and content you interact with, how often you use the Service, how long you are in the Service, and your subscription orders. We also record the ads in our Website with which you interact (and the Internet links to which those adds lead). 2.4. Transaction data. When you make payments through the Service, you need to provide financial account data, such as your credit card number, to our third-party service providers. We do not collect or store full credit card number data, though we may receive credit card-related data, data about the transaction, including: date, time and amount of the transaction, the type of payment method used. 2.5. Cookies. For what purposes we process your personal data We process your personal data: To provide our Service This includes enabling you to use the Service in a seamless manner and preventing or addressing Service errors or technical issues. To host personal data and enable our Website to operate and be distributed we use Amazon Web Services, which are hosting and backend services provided by Amazon.
    To manage your account and provide you with customer support
    We process your personal data to respond to your requests for technical support, service information or to any other communication you initiate. This includes accessing your account to address technical support requests. For this purpose, we may send you, for example, notifications or emails about the performance of our Service, security, payment transactions, notices regarding our Terms and conditions or this Privacy Policies.
    To communicate with you regarding your use of our Service
    We communicate with you, for example, by emails. These may include information about the Service, some critical changes, special offers. To opt-out of receiving emails, please advise my email and contact us. The services that we use for these purposes may collect data concerning the date and time when the message was viewed by our users, as well as when they interacted with it, such as by clicking on links included in the message.
    To research and analyze your use of the Service This helps us to better understand our business, analyze our operations, maintain, improve, innovate, plan, design, and develop the Service and our new products. We also use such data for statistical analysis purposes, to test and improve our offers. This enables us to better understand what features and learning plans of the Services our users like more, what categories of users use our Services. As a consequence, we often decide how to improve the Service based on the results obtained from this processing. For example, if we discover that users more often engage in specific topics about investments, we may develop and introduce extra chapters into this category.
    To analyze how visitors use our Service and to measure effectiveness of some ads we use Google Analytics, a web analysis program of Google In order to provide us with analytics, Google Analytics places cookies on your device. On Google Analytics we get, in particular, aggregated information on the data you enter on our Service and users’ interactions within the Service. Google allows you to influence the collection and processing of information generated by the Google, in particular, by installing a browser plug-in, available here.
    To send you marketing communications We process your personal data for our marketing campaigns. We may add your email address to our marketing list, provided we receive consent or otherwise establish legal basis for sending you marketing communications. As a result, you will receive information about our products, such as for example, special offers. If you do not want to receive marketing emails from us, you can unsubscribe following instructions in the footer of the marketing emails.
    To communicate with you we use ActiveCampaign, which is message sending service. We integrate Amplitude to create analytics-based audiences and track opening and conversion events.          
    To personalize our ads We and our partners, including Facebook and Google, use your personal data to tailor ads and possibly even show them to you at the relevant time. How to opt out or influence personalized advertising IOS: On your iPhone or iPad, go to “Settings,” then “Privacy” and tap “Advertising” to select “Personalized Ads”. In addition, you can reset your advertising identifier (this also may help you to see less of personalized ads) in the same section. Android: To opt-out of ads on an Android device, simply open the Google Settings app on your mobile phone, tap “Ads” and enable “Opt out of interest-based ads”. In addition, you can reset your advertising identifier in the same section (this also may help you to see less of personalized ads). macOS: On your MacBook, you can disable personalized ads: go to System Preferences > Security & Privacy > Privacy, select Apple Advertising, and deselect Personalized Ads. Windows: On your laptop running Windows 10, you shall select Start > Settings > Privacy and then turn off the setting for Let apps use advertising ID to make ads more interesting to you based on your app activity. We use Facebook pixel on the Service. Facebook pixel is a code placed on the Service collecting data that helps us track conversions from Facebook Ads, build targeted audience and remarket to people who have taken some actions on the Service (for example, made a purchase). We use Facebook Ads Manager together with Facebook Custom Audience, which allows us to choose audiences that will see our ads on Facebook or other Facebook’s products (for example, Instagram). Through Facebook Custom Audience we may create a list of users with certain sets of data to choose users that have completed certain actions in the Service (for example, bought it). As a result, we may ask Facebook to show some ads to a particular list of users. As a result, more of our ads may show up while you are using Facebook or other Facebook’s products (for example, Instagram). You may learn how to opt out of advertising provided to you through Facebook Custom Audience here. Facebook also allows its users to influence the types of ads they see on Facebook. To find how to control the ads you see on Facebook, please go here or adjust your ads settings on Facebook. Google Ads is an ad delivery service provided by Google that can deliver ads to users. In particular, Google allows us to tailor the ads in a way that they will appear, for example, only to users that have conducted certain actions with our Service (for example, show our ads to users who have purchased a subscription). Google allows its users to opt out of Google’s personalized ads and to prevent their data from being used by Google Analytics. The TikTok pixel is a piece of JavaScript code that helps Advertisers measure the cross-device impact of Campaigns. Advertisers will be able to see how many TikTokers take action on their Website(s) after seeing their Ad. TikTok Ads is the service provided by TikTok that can deliver ads to its users. The ads can be tailored to specific categories of users (for instance, based on their geographical location).TikTok’s Privacy Policy. 
    To process your payments We provide paid features and/or services within the Service. For this purpose, we use third-party services for payment processing (for example, payment processors). As a result of this processing, you will be able to make a payment for our Service and we will be notified that the payment has been made and will provide you with . We will not store or collect your payment card details ourselves. This information will be provided directly to our third-party payment processors.          
    To enforce our Terms and Conditions and to prevent and combat fraud We use personal data to enforce our agreements and contractual commitments, to detect, prevent, and combat fraud. As a result of such processing, we may share your information with others, including law enforcement agencies (in particular, if a dispute arises in connection with our Terms and Conditions.
